Terms of Service

The rules for using Cakonstruct: your account, your data, what the tool does and does not do, and how plans and payments work.

Last updated:

01Agreement to these terms

These terms govern your access to and use of the Cakonstruct website, web application and mobile application (together, the “Service”), provided by Cakonstruct (“we”, “us”). By creating an account, joining an organisation, or otherwise using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for an organisation, you confirm that you have the authority to accept these terms for it. You must be at least 18 years old.

02What the Service does

Cakonstruct is a construction management platform. Depending on your plan and role, it provides tools for project management, finance and invoicing, payroll and payslips, GPS-verified attendance, inventory, quantity surveying and bills of quantities, carbon assessments, hiring, and team communication.

We may add, change or remove features. We will try to give reasonable notice of changes that materially reduce what a paid plan provides.

03Accounts, organisations and roles

  • You must give accurate information and keep it up to date. You verify your email address to activate an account.
  • Keep your password and any codes private. You are responsible for activity under your account.
  • Organisations assign roles (owner, super admin, admin, staff, viewer, client). Owners and managers decide who joins, what each person can access, and are responsible for the people they invite or approve, including those who join with a join code.
  • Tell us promptly if you believe your account has been used without permission.

04Your data

You and your organisation keep ownership of the content and records you put into the Service (“Customer Data”). You give us permission to host, process, display and back up Customer Data as needed to provide and secure the Service, and to follow your instructions.

You are responsible for Customer Data. This includes having the right to enter it, and having any notices, permissions or legal basis needed to record personal information about other people, such as employee details, bank information, salaries, attendance and location records, and job applicants’ details.

How we handle personal data is described in the Privacy Policy.

05Acceptable use

You agree not to:

  • Break the law or infringe anyone’s rights while using the Service.
  • Upload unlawful, harmful or malicious content, including malware.
  • Try to access accounts, organisations or data that you are not authorised to access, or test or bypass our security or rate limits.
  • Interfere with or disrupt the Service, or overload it through automated or abusive use.
  • Falsify attendance, location, payroll or financial records.
  • Copy, resell, or reverse engineer the Service except as the law allows, or use it to build a competing product.
  • Use the Service to send spam or to harass others.

06Calculations, reports and reference data

The Service produces calculations and reports, including payroll and statutory deduction figures, tax and remittance schedules, bills of quantities, valuations and retention, rate and price references, and carbon assessments. It also includes attendance records that flag late arrivals or locations that differ from the project location.

These outputs are tools to help you. They depend on the information entered and on rules, rates and datasets that change over time, and some come from third-party sources. They are not legal, tax, accounting, surveying, engineering or other professional advice. You are responsible for checking them, and for how you rely on them, before you pay staff, file returns, issue documents, certify work or make decisions. Reference prices and benchmarks are indicative only.

07Plans, trials and payments

  • The Service is offered on free and paid plans. Plan features, limits, prices, billing periods and any free trial are shown when you choose or change a plan.
  • Paid plans are billed for the period you select. Payments are processed by third-party payment providers, whose terms also apply.
  • Prices may be shown in more than one currency. The amount charged is the amount shown at checkout.
  • Taxes may apply. You are responsible for any taxes due on your use of the Service, except taxes on our income.
  • You can cancel your subscription using the controls in the platform where available, or by contacting us. Whether any refund applies will depend on what was shown when you bought and on applicable law.
  • We may change prices for future billing periods, with notice before the change takes effect.

08Third-party services

The Service relies on and may link to third-party services, such as payment, file storage, mapping and email providers. We do not control them and are not responsible for their services or terms. Your use of them may be subject to their own terms.

09Our intellectual property

The Service, including its software, design, text, graphics and logos, belongs to us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own business purposes in line with these terms. Third-party datasets shown in the Service remain subject to their own licences and attribution requirements.

10Availability and support

We work to keep the Service available, but it may be interrupted for maintenance, updates, or reasons outside our control. The mobile app can queue some entries while you are offline, but information may not be up to date until you reconnect. We do not promise uninterrupted or error-free operation.

11Suspension and termination

You may stop using the Service at any time. We may suspend or end your access if you breach these terms, if payment is overdue, if needed to protect the Service or other users, or if the law requires.

When access ends, your right to use the Service ends. Sections that by their nature should continue to apply, such as those on liability, intellectual property and disputes, will continue. Contact us about your data after termination.

12Disclaimers and limits of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business, arising from your use of the Service. We are also not liable for losses caused by your Customer Data, by decisions you make based on the Service’s outputs, or by events beyond our reasonable control.

Nothing in these terms limits liability that cannot be limited or excluded by law.

13Changes to these terms

We may update these terms. We will post the new version here with a new “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use of the Service after a change takes effect means you accept the updated terms.
